These Terms of Service are a placeholder and have not been reviewed by legal counsel. They must be replaced with a legally reviewed document before mainnet launch. Consult a lawyer specialising in Canadian sweepstakes law, US securities regulations, and international gaming regulations.
1. Acceptance of Terms
By accessing or using the Velonosis protocol and consumer application (“the Service”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.
2. Nature of the Service
Velonosis is a prize pool protocol deployed on the Base blockchain. Participation involves purchasing a “Mark” NFT for $1 USDC which constitutes an entry into a prize pool. A single winner is selected via Chainlink Verifiable Random Function (VRF). Winners must answer a skill-testing question to claim their prize.
The inclusion of a mandatory skill-testing question is intended to classify participation as a game of skill rather than a pure game of chance under applicable Canadian law. This characterisation has not been confirmed by legal opinion and may vary by jurisdiction.
3. Eligible Participants
You must be of legal age to participate in prize competitions in your jurisdiction. Participation may be restricted or prohibited in certain jurisdictions. It is your responsibility to determine whether participation is lawful in your location.
Employees, contractors, and immediate family members of the Velonosis team are not eligible to participate.
4. Alternate Method of Entry (AMOE)
In compliance with Canadian sweepstakes regulations, no purchase is necessary to enter. An Alternate Method of Entry is available by contacting build@velonosis.xyz to request a free entry. Free entries are subject to pool availability.
5. Prize Pool Mechanics
Prize amounts are determined by pool capacity multiplied by the entry fee. All funds are held in the Pool smart contract and released only upon valid prize claim or emergency refund. Velonosis does not take custody of user funds beyond what is required for on-chain pool operations.
6. Smart Contract Risk
The Velonosis smart contracts have not undergone a professional security audit as of the date of this document. Participation during the testnet and pre-audit period is at your own risk. Mainnet deployment will not occur until a professional audit is complete.
7. No Warranty
The Service is provided “as is” without warranty of any kind. We do not guarantee uninterrupted availability, error-free operation, or that all prizes will be successfully distributed in every scenario.
8. Limitation of Liability
To the maximum extent permitted by law, the Velonosis team shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
9. Changes to Terms
We reserve the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the updated Terms.
